Terms of Service

These Terms of Service (“Terms”) govern access to and use of the SideKit platform, SDKs, APIs, and related services (“Services”) provided by SideKit (“we,” “our,” or “us”). By integrating, installing, or using the Services, you (“Developer,” “you”) agree to these Terms.
1. Eligibility
You must have the legal authority to enter into these Terms. If you are using the Services on behalf of an organization, you represent that you are authorized to bind that organization.
2. Use of the Services
2.1 License
We grant you a limited, revocable, non-exclusive, non-transferable license to integrate and use the SideKit SDK and APIs solely to support your applications.
2.2 Restrictions
You must not:
- Reverse-engineer, decompile, or modify the service beyond documented interfaces.
- Use the Services to violate any law or regulation.
- Send or attempt to send personally identifiable information (PII) to SideKit.
- Interfere with or disrupt the integrity or performance of the Services.
2.3 SDK Integration
You are responsible for:
- Implementing the SDK correctly
- Configuring which signals your app sends
- Ensuring that no PII is transmitted
- Disclosing your use of SideKit in your own privacy policy
3. Developer-Submitted Content
“Developer Content” means any data, signals, configurations, or metadata sent to SideKit through the SDK or API.
- You retain all rights to your Developer Content.
- You grant SideKit a worldwide, non-exclusive, royalty-free license to process Developer Content solely to provide the Services.
- You represent that you have all rights necessary to transmit Developer Content and that it does not include any PII.
4. Service Availability
SideKit aims to provide highly reliable availability but does not guarantee uninterrupted service. Interruptions, latency, or errors may occur due to maintenance, upgrades, or third-party infrastructure.
We reserve the right to modify, suspend, or discontinue the Services at any time with notice where commercially reasonable.
5. Fees and Billing
If you subscribe to a paid plan:
- Fees are billed according to the plan selected.
- Charges are non-refundable unless required by law.
- You remain responsible for all usage under your account.
- We may suspend access for non-payment after reasonable notice.
For free-tier users:
SideKit may set usage limits and may modify or discontinue the free tier at any time.
6. Privacy and Data Processing
Use of the Services is subject to the SideKit Privacy Policy.
- SideKit does not collect or store personal data.
- Cloudflare, our infrastructure provider, may temporarily process network-level metadata (e.g., IP addresses) for routing, delivery, and security. These operations are transient, not accessed by SideKit, and governed by Cloudflare’s own data protection terms.
- Developers are responsible for ensuring their applications comply with applicable privacy laws.
7. Security
We implement technical and administrative safeguards to protect the Services and Developer Content. You are responsible for:
- Protecting API keys
- Securing your application
- Preventing unauthorized use of your SideKit integration
You must notify us promptly of any suspected security incident related to your use of the Services.
8. Prohibited Conduct
You must not use the Services to:
- Perform or enable scraping, fingerprinting, or user-level tracking
- Store or transmit harmful code
- Interfere with network traffic or service operation
- Circumvent usage limits or billing rules
9. Intellectual Property
SideKit owns all rights in the Services, including SDKs, APIs, documentation, and technology. These Terms do not grant any ownership or exclusive rights.
You may not use our trademarks without written permission.
10. Disclaimer of Warranties
The Services are provided “as is” and “as available.”
We make no representations or warranties regarding accuracy, uptime, or suitability for your purpose.
11. Limitation of Liability
To the maximum extent permitted by law:
- SideKit will not be liable for indirect, incidental, special, consequential, or punitive damages.
- Our total liability arising out of or relating to the Services will not exceed the amounts paid by you in the preceding 12 months.
- If you use the free tier, our liability is limited to $0.
12. Indemnification
You agree to indemnify and hold SideKit harmless from any claims, damages, or expenses arising from:
- Your use of the Services
- Your integration of the SDK
- Violation of these Terms
- Transmission of unauthorized or unlawful Developer Content
13. Termination
You may stop using the Services at any time.
We may suspend or terminate your access if you:
- Breach these Terms
- Misuse the SDK
- Fail to pay fees
- Create security or legal risk
Upon termination, your license to use the SDK and APIs ends immediately.
14. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Any disputes shall be resolved in courts located in Delaware.
15. Changes to These Terms
We may update these Terms. Changes become effective when posted. Continued use of the Services constitutes acceptance of updated Terms.
